Website User Personal Data Processing Agreement

 

  1. This Website User Personal Data Processing Agreement (hereinafter referred to as the “Agreement”) covers any and all information that IXCELLERATE LLC, a personal data controller, place of business: 18/V/2/33G, Altyf`yevskoe Shosse, 127410 Moscow, Russia (hereinafter referred to as the “Company”), can source for an individual accessing the Company’s website from any device and communicating with the Company in any shape or form (hereinafter referred to as the “PD subject”).
  2. By accepting this Agreement and disclosing his details on the website at https://www.ixcellerate.com (hereinafter referred to as the “Website”), by completing the fields of the feedback form or entering into any other interaction with the Website, the PD subject:
  • acknowledges that all the data provided by him are owned by him personally;
  • acknowledges and agrees that he has closely read all of this Agreement and the terms of processing of his personal data (hereinafter referred to as “PD”) and that he understands the text of the Agreement and the terms of personal data processing;
  • authorizes the processing of his personal data, namely the performance of the actions provided for in cl. 3 pt. 1 art. 3 of the Federal Law of 27.07.2006, No. 152-FZ, “On personal data”, to enable the execution hereof between him and the Website, as well as the subsequent performance hereof, and acknowledges that in giving such consent he acts freely, of his own free will and in his own interest;
  • gives consent to the disclosure of his personal data to third parties for the purposes of statistical treatment thereof with a view to subsequent processing thereof in the systems Google Analytics and Yandex.Metrica;
  • gives consent to cross-border transfer of his personal data into the territory of the following foreign countries: the USA.
  • accepts the terms of personal data processing.
  1. The consent of a PD subject to the processing of personal data is specific, informed and explicit.
  2. Consent is given to the processing of the following personal data:

PD of the Company’s employees:

  • Name
  • Job title
  • Place of employment
  • Photo
  • Professional experience
  • Educational background

PD of potential customers:

  • Name
  • E-mail address
  • Phone number

PD of website users:

  • Full name;
  • Email address;
  • IP address;
  • Contents of cookie files;
  • Location data;
  • URLs of requested pages, searches;
  • Description of device, specifications of hardware and software.
  1. Purposes of personal data processing:
  • identification of the PD subject;
  • processing of enquiries and requests from a PD subject, incl. for arranging a tour of the Data Centre remotely;
  • entering into feedback arrangements with a PD subject, including the sending of notices, offers, enquiries and requests pertaining to the performance of the Website and provision of services;
  • verification and validation of the personal data made available by a PD subject;
  • provision of customer and technical support to a PD subject in the event of problems arising when using the Website;
  • statistical analysis, collection of information about the use of the website by a PD subject.
  1. Authority for personal data processing is provided by:
  • 6 of Federal Law No. 152-FZ, “On personal data”;
  • this Agreement for the processing of personal data;
  • the data subject’s consent to PD processing;
  • the data subject’s consent to receipt of e-mail advertisements;
  • an employee’s consent to the processing of personal data authorized for dissemination.
  1. The processing of personal data will involve the following activities: collection; recording; organization; accumulation; storage; updating (refreshing, modification); extraction; use; dissemination, blocking; deletion; destruction; transfer (for a list of third parties to whom data can be disclosed, if necessary, please follow the link.
  2. The personal data of the Company’s staff (executive officers) that are published on the website are only meant to inform customers and website users about the experience and expertise of the Company’s management. Third parties may not use the personal data published for any other purpose. A ban is imposed on the disclosure (except for provision of access via the website) of personal data to the public at large, as well as a ban on the processing (except for access purposes) of the personal data involved by any member of the public pursuant to art. 10 of the Federal Law of 27.07.2006, No. 152-FZ, “On personal data”.
  3. This Agreement shall come into effect when data are provided. A PD subject’s consent to the processing of personal data can be revoked by submitting an application to the Website Administrators complete with the details specified in art. 14 of the Personal Data Law.
  4. A personal data processing consent can be revoked by a PD subject giving instructions to this effect in writing by e-mail at: info@ixcellerate.com.
  5. Website Administrators are entitled to make changes hereto. When amended, the current version will specify the date of the latest update. The restated version of the Agreement shall come into effect when posted, unless otherwise stipulated in the restated Agreement.
